Protech Concepts Limited ("Protech", "we", "us") provides cloud-based business management software including ProtechBooks POS, StayIO, Fleet, and NyumbaLink (the "Service") to businesses in Kenya and the East African region ("you", "Customer").
You are responsible for keeping your login credentials confidential and for all activity under your account. You must be at least 18 years old and authorised to enter contracts on behalf of your business.
The Service is billed monthly or annually in advance in Kenya Shillings (KSh) via M-Pesa. Your chosen plan is shown on sign-up. After the free trial, continued use requires an active paid subscription. We will send M-Pesa prompts and SMS reminders before any access change.
If payment lapses, your account moves to read-only for 7 days (grace period), then is suspended for up to 30 days. Your data is never deleted during this period. You may export your data at any time, including while suspended.
Your business data is yours. We store it on your behalf and do not sell, share, or use it for any purpose other than operating the Service for you. On request, or on termination, we will provide a full export within 5 business days.
You may not use the Service for unlawful purposes, to process fraudulent transactions, to attempt unauthorised access to any system, or in any way that violates applicable Kenyan law including the Computer Misuse and Cybercrimes Act 2018 and the Tax Procedures Act.
The eTIMS integration transmits tax invoices to the Kenya Revenue Authority on your behalf. You remain the taxpayer of record and are responsible for the accuracy of the data you enter. We are a technology intermediary, not a tax agent.
We aim for 99.5% monthly uptime. Planned maintenance is announced at least 24 hours in advance. We are not liable for downtime caused by third-party services (M-Pesa, KRA eTIMS, internet connectivity).
To the extent permitted by Kenyan law, our total liability for any claim arising from use of the Service is limited to the subscription fees you paid in the three months preceding the claim. We are not liable for indirect or consequential losses.
We will give at least 30 days' notice of material changes via email and in-app notice. Continued use after the notice period constitutes acceptance.
These terms are governed by the laws of Kenya. Disputes shall be resolved in the courts of Nairobi, Kenya.
